Legal Action

A group of neighbors in the community created Friends of The Equestrian Bridge (FOTEB), a 501(c)(3) non profit corporation, and filed 2 lawsuits against the City of Burbank, challenging that the 2 SB35 applications did not qualify for approval. There is a Status Conference for “Mariposa 1” on March 20th, 2025, and there is no court hearing date set yet for “Mariposa 2.” Both cases will be decided by the same judge, who will make a decision in a hearing that will not be open to the public, but we at Cancel the Condos will keep you updated.

“Mariposa 1” lawsuit was filed on october 18th, 2023

by Friends of the Equestrian Bridge against the City of Burbank.

This case challenges the city’s approval of Mariposa 1 on the grounds that the project does not comply with the statutory requirements of Senate bill 35.

The Petiton

Petitioner challenges the approval by Respondent City of Burbank (“City” or “Respondent”) of a 23-unit, three-story (over 42 feet) townhome development consisting of 6 buildings and 76 bedrooms on a 1.01-acre site located at 910 South Mariposa Street (“Project”).

As explained below, Petitioner contends Project is not eligible for approval pursuant to Senate Bill (SB) 35, which is codified at Government Code Section 65913.4. As a result, the City erred when it processed the application subject to the corresponding requirements in Burbank Municipal Code (BMC) Title 10, Chapter 1 (Zoning), Article 19 (Zoning Procedures and Amendments), Division 12 (Streamlined Ministerial Approval Process).

Petitioner requests that this Court vacate, set aside, rescind and void any permits, plans, specifications or approvals granted by the City (“Project Approvals”) in order to facilitate the Project. Petitioner requests that the Court vacate the Project Approvals because the Project does not meet the requirements of SB 35 and the City therefore failed to proceed in a manner required by law when it approved the Project.

On december 26th, 2023 The developers filed a 2nd application known as “Mariposa 2” for an even bigger Condo development

After the lawsuit was filed against the first application, the developers submitted a 2nd SB35 project application for the same property on December 26th, 2023, just 4 days before the Rancho equestrian district would be protected from SB35 development by SB423, an amendment passed to prevent developments like this in California equestrian neighborhoods.

This proposed development would be 5 stories, including 40 units, and subterranean parking.

On november 26th, 2024 Burbank City council voted to approve the application

“Mariposa 2” lawsuit was filed on Feb18th, 2025

by Friends of the Equestrian Bridge against the City of Burbank.

This 2nd case challenges the city’s approval of Mariposa 2 on the grounds that the project does not comply with the statutory requirements of Senate bill 35

and

the city failed to provide the public timely access to Public hearing documents and failed to provide a fair hearing.
